The petitioner seeks bail in connection with Warisaliganj P.S. Case No. 65 of 2020 dated 05.03.2020 instituted for the offences under Sections 30(a) of the Bihar Prohibition and Excise Act.

45 liters of liquor is said to have been recovered from the toilet of a public building.

The petitioner is sought to be prosecuted in this case on the basis of information of local people about his dealing in liquor.

The petitioner though has been made accused in cases of similar nature, but all theses cases have been lodged in the

Patna High Court CR. MISC. No.54830 of 2021(2) dt.26-05-2022 2/2 same police station. Perhaps because of his earlier implication in criminal cases of similar nature, he has been remanded in this case as well.

The petitioner is in custody since 03.04.2021. It has been urged that such recovery from a toilet of a public building cannot be saddled against him. Considering the period of custody of the petitioner and the nature of accusation, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge- II- cum Special Judge, Nawada in connection with Warisaliganj P.S. Case No. 65 of 2020.
