JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-08-2024 The present writ petition has been filed seeking the following reliefs:- "1(i). For issuance of appropriate writ/s, order/s, direction/s in the nature of mandamus for commanding and directing the Respondents 1st set to conduct a physical verification / inquiry and remove the illegal encroachment of the Respondent 2nd set over the land of the

(ii). For further issue a direction in view of the larger public interest for the Respondents 2nd set to immediately remove the illegal encroachment boundary wall from the public road connecting the Mohalla Sahjadpur, Andar Quila to Main Road Konhara Ghat as the Respondent 2nd set occupied surplus land as then they have acquired and closed the road which was being used by the inhabitants of the Sahjadpur (Hajipur) since a long time but now their ingress has been disturbed by the Respondent 2nd set.

(iii). For further direction to restrain the Respondent 2nd set to not create hardship and stop the construction over the land in question." 2.

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to approach the District Magistrate, Hajipur, Vaishali / Circle Officer, Hajipur, Vaishali, for redressal of his aforesaid grievances. Liberty, so sought, is granted.
