JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-08-2016 The present application has been filed for modification of the order dated 06.02.2015 passed in Cr. Misc. No. 36046 of 2014 to the extent of modifying the conditions as stipulated in the order dated 06.02.2015. The conditions stipulated in the order dated 06.02.2015 passed in Cr. Misc. No. 36046 of 2014 reads as follows:- "The petitioner will appear in every fortnight before the concerned police station and will mark his attendance and the concerned police station will forward the attendance report of the petitioner to the learned court below. The petitioner will not leave the district of Patna for next one year without prior permission from the learned trial court. The learned court below will cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of

Patna High Court Cr.Misc. No.33431 of 2016 (2) dt.31-08-2016 2/2 offence or defaults for two consecutive occasions." It is submitted by learned counsel for the petitioner that so far as making attendance before the police is concerned, the same has no relevance since the investigation has already concluded and petitioner has complied the conditions for one and half years since order was passed on 06.02.2015.

Mr. Akhileshwar Prasad Singh, learned senior counsel for the Economic Offences Unit does not controvert this fact that investigation has already concluded and he has no objection in modification of the order dated 06.02.2015 passed in Cr. Misc. No. 36046 of 2014, provided the petitioner cooperates in the trial.

In the circumstances, the order dated 06.02.2015 passed in Cr. Misc. No. 36046 of 2014 is modified, so far as conditions of bail is concerned, to the extent that learned trial court will be at liberty to cancel the bail bonds of the petitioner, if the petitioner defaults for three consecutive occasions during the trial.

The order dated 06.02.2015 passed in Cr.

Misc. No. 36046 of 2014 stands modified to the extent as indicated above.
