JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 12-01-2018 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner, in the present case, is seeking regular bail in connection with Bahbua P.S. Case No.645 of 2017, registered for offences alleged under Section 302/34 of the Indian Penal Code.

It is submitted by learned counsel for the petitioner that from perusal of the FIR itself it would appear that whole allegation of committing overt act causing death of the victim has been made against one Vikash Kumar Kushwaha. So far as the present petitioner is concerned, his name has not transpired in the matter of alleged occurrence, however, later on his name has been mentioned in the FIR.

Patna High Court Cr.Misc. No.269 of 2018 (2) dt.12-01-2018 On the other hand, learned counsel for the informant submits that even though there is no direct allegation against this petitioner, but he was involved in the occurrence. Learned APP opposed the prayer for bail.

Considering the facts and circumstances, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Kaimur at Bhabua in connection with Bahbua P.S. Case No.645 of 2017, subject to the conditions U/S 437(3) Cr.P.C.
