The present application has been filed for restoration of Cr.Misc. No.57193 of 2015 which stood dismissed for want of prosecution vide order dated 18.5.2016.
Learned counsel for the petitioner has submitted that while he was arguing in another court, the case was called out and, as such, he could not attend the court and the case was dismissed due to non-prosecution.
On the facts and in the circumstances of the case, the prayer is allowed.
The Registry is directed to restore Cr.Misc. No.57193 of
Patna High Court Cr.Misc. No.29887 of 2016 (2) dt.20-06-2016 2/2 2015 to its original file.
