The petitioner seeks bail in Muffasil P.S. Case No. 321 of 2016 registered under Section 47 of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 135 liters of country made liquor is said to have been recovered from the Ishwari Halt being carried by two persons including the petitioner who managed to escape seeing the police party.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He has been falsely implicated in this case. He has no concern with the seized

Patna High Court Cr.Misc. No.2149 of 2018 (02) dt.23-01-2018 2/ 2 liquor. He has no criminal antecedent. The petitioner has been languishing in custody since 03.07.2017. . In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Excise Judge, Gaya in connection with Muffasil P.S. Case No.321 of 2016.
