JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-01-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 302 and other ancillary sections of the Indian Penal Code, section 27 of the Arms Act and 3⁄4 of the Explosive Substance Act. As per the prosecution case, four unknown miscreants killed the son of the informant. They also exploded bomb. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to suspicion because of previous enmity. He submits that on the order of this Court passed in C.W.J.C.No. 2265 of 2020, filed by the petitioner, action had been taken against the informant. Thereafter this case has been filed implicating the petitioner. No other substantive evidence has been collected
Patna High Court CR. MISC. No.54333 of 2021(2) dt.28-01-2022 2/2 during course of investigation to suggest the implication of this petitioner in the present case. Petitioner is in custody since 7.6.2021. Investigation is complete. Similarly situated coaccused has already been allowed bail by a co-ordinate bench of this Court vide order passed in Cr.Misc.No. 31067/2021. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in Mirganj Police Station Case No. 8/2021.
