JUSTICE ARUN KUMAR ORAL ORDER 08-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Balia P.S.Case No. 173 of 2007 registered under Sections 304B and 201/34 of the Indian penal Code.

It's a case of dowry death. Petitioner is said to be brotherin-law of the deceased. He remained absconding for a decade and rest other accused persons were put on trial and in the meanwhile, as it is submitted, they were acquitted and petitioner was apprehended only on 17.10.2017 and as submitted charge has been framed.

Having considered the aforesaid facts and circumstances and as the petitioner has remained absconder for such a long period, presently the prayer of bail of the petitioner is refused with a direction to the trial court to expedite the trial and conclude the

Patna High Court Cr.Misc. No.2370 of 2018 (4) dt.08-02-2018 2/2 same preferably within a period of six months. If the trial is not concluded, petitioner may renew his prayer for bail after six months.
