JUSTICE ARUN KUMAR ORAL ORDER 18-01-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Dariyapur P.S.Case No. 182 of 2017 registered under Section 414 of the Indian penal Code and Sections 25(1-b)a,26 and 35 of the Arms Act.

Allegation in brief is that demand of levy by way of extortion money of Rs. 5 lacs was made from petrol pump owner, the police led a trap and the petitioner and one another were apprehended while they have come to collect money. Submission is that there is no other recovery against the petitioner except a mobile and recovery of country made pistol was from another co-accused and not from this petitioner. Having considered the aforesaid facts and circumstances of the case and the nature of offence, I am not inclined to admit the

Patna High Court Cr.Misc. No.57544 of 2017 (3) dt.18-01-2018 2/2 petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected.

However, trial court is directed to expedite the trial and conclude the same preferably within a year.
