JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-07-2019 This is an application for grant of anticipatory bail in connection with Sasaram (Muffasil) P.S. Case No. 49 of 2019, disclosing offences under Section 370(A) of IPC read with Section 14(A) of the Child and Adolescent Labour (Prohibition & Regulation) Act, 1986.

Prosecution story as per the complaint lodged by the Deputy Labour Commissioner, Sasaram is that petitioner has employed 14 years old boy and in spite of notice, the petitioner has not appeared to submit his show cause. .

Submission of the learned counsel for the petitioner is that the show cause has been issued four days prior to filing of the same and moreover, he has annexed the Aadhar Card of the said boy showing that he was aged about 15 years and boy does not come under the purview of child labour. Apart from that he is ready to co-operate in the trial, if the charge sheet is submitted

Patna High Court CR. MISC. No.42657 of 2019(2) dt.10-07-2019 2/2 against him and abide by the conditions imposed upon him. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Sasaram (Muffasil) P.S. Case No. 49 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
