In this case, the petitioner is seeking anticipatory bail in connection with Dinara (Bhanas) P.S. Case No. 76 of 2019 registered for offence punishable under sections 341, 323, 324, 307, 379/34 of the Indian Penal Code and section 27 of the Arms Act.
As per the allegation made in the FIR that the son of informant had gone to purchase the medicine for his mother, he reached near the door of Akshaywar Singh where Akshaywar Singh, Sanjit Paswan, Butan Paswan, Bhuar Paswan were sitting and when the son of informant flashed the torch towards them, on that account, they started hurling abuses
Patna High Court CR. MISC. No.43740 of 2019(2) dt.16-07-2019 2/3 and started assaulting with lathi and danda and also took away Rs.1000/- from him. They have resorted to force on the vital part of his body, inasmuch as they have fired upon him, but it did not hit and anyhow he fled away from there, came his house and closed the door.
The learned counsel for the petitioner submits that it is a concocted story. This case is counter blast to the case which was earlier lodged against the informant by co-accused Akshayar Paswan, vide Dinara (Bhanas) P.S. Case No. 75 of 2019 for offences under sections 341, 323, 354/34 of the Indian Penal Code, section 3 (f) (r) of the SC/ST Act and section 27 of the Arms Act.
Looking to the nature of allegation, the prayer for bail of the petitioner is allowed and he, in the event of arrest or surrender before the court below within six weeks from today, is directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Bikramganj, Rohtas at Sasaram in connection with Dinara (Bhanas) P.S. Case No. 76 of 2019, subject to the conditions as laid down under section 438 Cr. PC and also subject to the condition that one of the bailors of the petitioner shall be a local
