2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 126, 115 , 118 , 109, 303 , 76, 352 and 3(5) of BNS.

3 . As per F.I.R., on the order of co-accused Brij Kishore, co-accused Vijay Rai gave farsa blow on the head of informant due to which he sustained injury . It is further alleged that this petitioner snatched mangalsutra from the neck of sisterin -law of informant.

4. It is submitted on behalf of the petitioners that petitioner is innocent and has committed no offence as alleged. Specific accusation of assault is against co-accused Vijay Rai.

Patna High Court CR. MISC. No.44775 of 2025(3) dt.18-08-2025 2/2 So far as this petitioner is concerned, there is no allegation of assault against him. Rest of the allegation is ornamental in nature . Moreover, co-accused Vijay Rai and co-accused Brij Kishore Rai have already been granted bail by this Hon'ble Court vide order dated 15.05.2025 in Cr. Misc. No. 856 of 2025 .

5 . Learned counsel for the State opposed the bail petition .

6 Considering the aforesaid facts and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate - 1st Class, East Champaran Motihari in connection with Dumariyaghat P.S. Case No. 190 of 2024 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 .
