In the present writ application, the petitioner has prayed for issuance of an appropriate writ, order or direction commanding the respondent to remove encroachment from the land of the petitioner bearing Khata No.205, Khesra No.651 area 2 decimals in Mauza Tikaili, over which without any valid acquisition and compensation the Respondent No.3 has constructed pakki road.

Patna High Court CWJC No.3725 of 2014(4) dt.08-03-2019 2/2 It has been submitted on behalf of the petitioner that the public road has been constructed on the land belonging to the petitioner without initiating any acquisition proceeding or making payment of compensation amount.

Considering the aforesaid facts, the petitioner is directed to file an application/representation before the Collector-cum-District Magistrate, Katihar (Respondent No.2) within a period of 30 days from today. The Respondent No.2 shall consider the application/representation of the petitioner and pass an appropriate order in accordance with law within a period of six months from the date of filing of such application/representation.

With the aforesaid observation and direction, the present writ application stands disposed of.
