JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Allauli P.S. case No.90 of 2016 registered under Sections 467, 468, 471, 420 and 120(B)/34 of the I.P.C.

The accusation against the petitioner is that he got appointed himself as Panchayat teacher on the basis of forged degree.

The submission on behalf of the petitioner is that petitioner got degree from the Board of Secondary Education, New Delhi and later on it was detected that the aforesaid institution was not affiliated with U.P. Board, Allahabad. However, the petitioner and several other students got degree from

Patna High Court Cr.Misc. No.27970 of 2016 (3) dt.09-11-2016 2/2 the above stated institution and as a matter of fact the petitioner and others themselves cheated by the aforesaid Institute. It is further submitted that having similar allegation co-accused Rajeev Kumar and Seema Kumari have already been admitted anticipatory bail by different Benches of this Court. It is also pointed out that in Khagaria district several cases were lodged and several accused of those cases are enjoying the privilege of bail. Considering the aforesaid facts and circumstances as well as submission of the parties and also to maintain the parity of justice, in the event of arrest/surrender within six weeks from the date of receipt of this order to the concerned court, let the petitioner above named be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Khagaria in connection with Allauli P.S. case No.90 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
