Petitioner apprehends his arrest in a case instituted under Sections 354(B) of the Indian Penal Code and Section 8 of the Protection of Children from Sexual Offences Act, 2012 (POCSO Act).
Learned counsel submits that though the incident is of 01.04.2016, the case has been instituted on 03.04.2016. He next submits that the petitioner has been falsely implicated in this case as he a charge-sheeted the witness against the prosecution side in Lauriya P.S. Case No. 43 of 2014. Besides this, he has earlier lodged Lauriya P.S. Case No. 39 of 2016 also against the informant.
Having regard to the fact that the petitioner has lodged a
Patna High Court Cr.Misc. No.25692 of 2016 (2) dt.05-07-2016 2/2 case against informant and is also a witness in another case noticed above, in case of arrest/surrender, let the petitioner named above, be released on bail on furnishing bail bond of Rs.5,000/- with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge, Special Court under POCSO Act, West Champaran at Bettiah in connection with Lauriya P.S.
