2. The petitioner is apprehending his arrest in connection with Motihari Mahila P.S. Case No. 40/2021 dated 03.06.2021, registered for the offences punishable under Section 376(DA) of the Indian Penal Code and Sections 4, 6 and 10 of the POCSO Act pending in the Court of learned Additional Sessions Judge-VI-Cum-Special Judge, POCSO Act, East Champaran at Motihari.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, the instant application is dismissed as withdrawn.

6. However, if the petitioner surrenders before the learned Court below within a period of six weeks from today and seeks regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order considering this fact that one of the co-accused was acquitted by the trial Court itself.
