The petitioner is in custody in connection with Gandhi Maidan P.S. Case No. 449 of 2017, a case under Section 382 of the Indian Penal Code.

Petitioner is not named in the F.I.R. rather F.I.R. is against unknown. One of the co-accused was apprehended during investigation and he confessed before the police that he had snatched the chain and sold to this petitioner. Learned counsel for the petitioner submits that the petitioner is in custody since 26.09.2017. However, he was neither put on Test Identification Parade nor nothing has been

Patna High Court Cr.Misc. No.57617 of 2017 (3) dt.05-01-2018 P2/ recovered from the possession of the petitioner. He further submits that petitioner has been made accused in some other cases soon after the present case, which the petitioner has disclosed in the supplementary affidavit.

Learned counsel for the informant opposed the prayer for bail on the ground that since the petitioner had purchased the stolen property there is presumption that he had knowledge that the chain was stolen property. Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Gandhi Maidan P.S. Case No. 449 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
