Permission is accorded.

Accordingly, the application with regard to petitioner no.3 Baban Yadav is dismissed as withdrawn.

Patna High Court CR. MISC. No.46816 of 2023(2) dt.30-08-2023 2/2 learned A.P.P. for the State.

Petitioner nos.1, 2, 4 to 7 apprehend their arrest in connection with Sahpur P.S. Case No.170 of 2023 registered under Section 307 of the Indian Penal Code and other allied sections of the I.P.C.

Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. There is a case and counter case between both the sides and both parties have sustained injuries.

Having considered the facts and circumstances of the case, let the above named petitioner nos.1, 2, 4 to 7 be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bonds to the satisfaction of C.J.M., Bhojpur at Ara in connection with Sahpur P.S. Case No.170 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
