2. The petitioner is the husband of the deceased who apprehends his arrest in connection with Paroo P.S. Case No. 328 of 2020 for the offences punishable under Sections 304(B)/201/34 of the Indian Penal Code.
3. The allegation is that he has participated in the killing of the deceased. He along with his family members were torturing and killed the deceased for dowry.
4. Learned counsel for the petitioner submits that the deceased was suffering from Schizophrenia and she was under treatment of doctors. The prescription of Dr. G.P. Singh, an expert Neuro Psychiatrist has been annexed with the petition. During the investigation, the witness has said that the deceased
Patna High Court CR. MISC. No.49577 of 2024(2) dt.02-08-2024 2/2 was a patient of Schizophrenia and she committed suicide leaving behind one child who is living with the family of the petitioner.
5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Muzaffarpur, in connection with Paroo P.S. Case No. 328 of 2020, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973. (Sandeep Kumar, J) Saif/- U T
