2. Petitioner is in custody in a case registered for the offence punishable under Sections 140(3) and 3(5) of the B.N.S.

3. As per the prosecution case, it is alleged that petitioner along with other co-accused person has kidnapped the informant's son.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He next submits that petitioner is not named in the FIR and name of the petitioner has been transpired from the confessional statement of the co-accused, namely, Praveen Kumar. He further submits that neither any incriminating article nor the recovery of the informant's son has been made from the possession of the petitioner. He further submits that from perusal of the case diary, it appears that son of the informant

Patna High Court CR. MISC. No.44538 of 2025(3) dt.03-09-2025 2/2 was recovered from the possession of the co-accused, namely, Praveen Kumar. He next submits that petitioner is in custody since 12.05.2025 and has got clean antecedents as stated in para3 of the bail petition.

5. Learned APP for the State opposes the prayer for Regular bail of the petitioner.

On perusal of the First Information Report, case diary as well as impugned order date 05.06.2025, it appears that petitioner is not named in the FIR and name of the petitioner has been transpired on the basis of confessional statement of the coaccused person, namely, Praveen Kumar and also the fact that informant's son has been recovered from the possession of the said co-accused, namely, Praveen Kumar. So, considering the facts and circumstances of the case as well as the submissions made by learned counsel for the petitioner, let the above named petitioner be released on bail, on her furnishing bail bonds of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Learned Chief Judicial Magistrate, Darbhanga in connection with Simri Bazar P.S. Case No.146 of 2025.
