JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 09-05-2016 Heard Mr. Purushotam Kumar Jha for the petitioner, Mr. Jha for the State and Mr. Manish Kumar for the respondent Bhagalpur Municipal Corporation (for short 'the Corporation'). This writ application relates to the payment of the admissible dues of the petitioner who claims to have worked on the promoted post of Heavy Motor Vehicle driver. Mr. Jha states that a representation is pending in respect of the said claim before the appropriate/competent authority of the Corporation. The petitioner would be satisfied if the aforesaid representation is directed to be considered/examined by the Municipal Commissioner and pay the admissible dues to him.
Patna High Court CWJC No.1588 of 2015 (3) dt.09-05-2016 Mr. Manish Kumar, on the other hand, states that if such a representation is filed the said respondent shall examine the same and take appropriate decision and/or pass appropriate order in accordance with law granting him the benefits admissible to him. If there is refusal an order shall be passed and communicated. Mr. Kumar states that Annexure-5 of the writ petition shall be considered as a representation of the petitioner which shall be considered by the Municipal Commissioner.
In view of the aforesaid, the writ application stands disposed of. Let the Municipal Commissioner and/or any other appropriate authority of the Corporation examine the said grievance of the petitioner detailed in the Annxure-5 and take appropriate decision and/or pass orders in accordance with law as quickly as possible preferably within three months.
