This is an appeal under Section14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 against the refusal of prayer for bail by order dated 24.09.2018 passed by the learned 1st Additional Sessions Judge-cum-Special Judge, East Champaran, Motihari in connection with Pipra P.S. Case No.10/17 registered under Sections 302, 120B of the Indian Penal Code, Section 27 of the Arms Act and Section 3(2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. Allegation against the petitioner is to have killed the brother of the informant by firearm along with F.I.R. named accused.

It has been submitted on behalf of the appellant that

Patna High Court CR. APP (SJ) No.4617 of 2018(6) dt.27-02-2019 2/2 he is innocent and has falsely been implicated in this case. Appellant has no criminal antecedent and he is in custody since16.09.2018.

Considering the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the appellant on bail. Hence, the prayer for bail of the appellant is hereby rejected.

However, the appellant would be at liberty to renew his prayer for bail after one year in jail custody. (S. Kumar, J) Sanjay/- U T
