Learned counsel for the petitioner undertakes to remove the defects as pointed out by the office within four weeks of normal functioning of the court, failing which the office is directed to place the matter before the Bench. The petitioner seeks bail in a case registered for the offence punishable under Sections 420, 406, 120(B) of the Indian Penal Code.

Prosecution case in brief is that the informant received information that some altercation has taken place near SBI ATM in Nai Bazar. A raid was conducted and two co-accused persons, namely Krishna Nand Singh and Roushan Kumar Bharti were

Patna High Court CR. MISC. No.1518 of 2021(2) dt.09-03-2021 2/3 apprehended who disclosed that there is a group of five people who have arrived by one Bolero Car from Uttar Pradesh and they are scheduled to assemble at Syndigate, Buxar. On the aforesaid disclosure made by the co-accused, police reached at the intersection near Syndigate and apprehended three persons including this petitioner who were sitting in the Bolero Car and one mobile phone and two SBI ATM Cards have been recovered from the possession of the petitioner.

Learned counsel for the petitioner submits that the there is no allegation of cheating or duping or any wrongful loss to any person. Charges have already been framed. The petitioner is languishing in judicial custody since 15.09.2020. The petitioner has got no criminal antecedent which is mentioned in para 3 of the bail petition. The similarly situated co-accused has been granted bail by this Hon'ble Court vide order dated 04.03.2021 passed in Cr. Misc. No.1818/2021.

Learned APP for the State opposes the prayer for bail of the petitioner.

Considering the rival submissions and materials available on record and the nature of accusation coupled with the fact that the petitioner has got clean antecedent, let the petitioner, above named, be released on bail on furnishing bail

Patna High Court CR. MISC. No.1518 of 2021(2) dt.09-03-2021 3/3 bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each in connection with Buxar Town P.S. Case No. 402/2020 to the satisfaction of the learned court below where the case is pending, subject to the following conditions:

(1) The petitioner shall co-operate in the trial and shal be properly represented on each and every date fixed by the Court and shall remain physically present, as directed by the Court on his absence on two consecutive dates without sufficient reasons, his bail bonds shall be liable to be cancelled by the learned court concerned.

(2) If the petitioner tempers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
