2. The petitioner seeks regular bail in connection with Katra P.S. Case No. 58 of 2025 dated 19.03.2025 registered for the offence(s) punishable under Sections 126(2), 115(2), 109, 351(2), 351(4) and 3(5) of the B.N.S.
3. As per the prosecution story, on 15th March 2025 at about 9:00 A.M., the informant Brajesh Mandal was seated at the doorstep of his residence when seven individuals including the petitioner armed with lathis and iron rods, arrived and began to verbally abuse the informant. Upon his protest, the petitioner along with his son Ankur Mandal is alleged to have assaulted

No.43614 of 2025(2) dt.18-07-2025 2/3 the informant with an iron rod causing a head injury further more, co-accused Mithu Baitha is alleged to have bitten the informant on the waist while another co-accused, Rajan Kumar inflicted bamboo stick (phatta) blow on the shoulder and the back of the informant causing serious injuries.

The main submissions advanced by the petitioner's counsel are that the petitioner has fair and clean antecedent and languishing in jail since 05.05.2025 and he has been made accused mainly on account of Katra P.S. Case No. 55 of 2025 registered under Sections 126(2), 115(2), 109, 351(2), 351(3), 351(4), 3(5) of the B.N.S. and Section 3(i)(r) of the SC/ST Act which was lodged by the co-accused Rajan Baitha @ Rajan Kumar against the informant and others.
5. Learned APP appearing for the State has opposed the bail prayer.
6. Heard both the sides and perused the FIR and injury report of the informant. Against this petitioner, there is specific allegation of having assaulted on the head of the informant by using an iron rod, though, same allegation is also against the co-accused Ankur Kumar, however, considering the grievous injury found on the head of the informant as reflects from his injury report filed with this petition as Annexure- P/2,
