The petitioner has preferred this application for grant of regular bail in a case registered under sections 307, 448 and 34 of the Indian Penal Code and section 27 of the Arms Act. As per allegations in the F.I.R., it is stated by the informant that the three accused persons shot at him as a result of which, he sustained gunshot injury in his back. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. From the F.I.R. itself, it would be evident that the informant has not seen the actual assailant. Only one gunshot injury has been found on the body of the informant. The petitioner is in custody
Patna High Court CR. MISC. No.41107 of 2020(5) dt.16-08-2021 2/2 since 22.5.2020 and investigation in the case has concluded. It is lastly submitted that the misunderstanding between the parties has been settled by entering into a compromise. Heard learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner which is supported from the injury report of the informant, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.
