JUSTICE SATYAVRAT VERMA ORAL ORDER 07-07-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 323, 313, 498(A) and 34 of the IPC and Section 3 and 4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and being husband has been falsely implicated in the present case, it is next submitted that though attempts were made to revive the conjugal relationship but the same did not materialize and the

No.44159 of 2022(7) dt.07-07-2023 2/3 petitioner is willing to maintain the informant and the children for which he is willing to pay an amount of Rs. 6,000/- by way of monthly maintenance, it is further submitted that petitioner works as a sweeper in a company in Hyderabad. The learned counsel for the informant does not dispute the submission made by the learned counsel for the petitioner based on instruction of the informant. The learned counsel further submits that she will WhatsApp the bank account number of the informant on the WhatsApp number of the learned counsel for the petitioner and the learned counsel for the petitioner submits that the moment he receives the bank account number of the informant, he will start crediting the maintenance amount as agreed which shall commence from 21.07.2023.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Mahila P.S. Case

However, it is made clear that in the event, if the petitioner does not deposit the amount of maintenance as agreed, the informant shall be at liberty to file an application seeking cancellation of his bail before this Court.
