The petitioner seeks anticipatory bail in connection with K. Nagar P.S. Case No. 569 of 2013, registered for offences punishable under Sections 147, 148, 149,447, 427, 379, 353, 109, 337, 338, 332, 333, 323, 324, 326, 307, 329 and 506 of the Indian Penal Code.
As per F.I.R., allegation against the petitioner is that the petitioner along with other 150-200 persons creating unlawful assembly and making hindrance to perform the official duty of police personnel.
Submission of the learned counsel for the petitioner is that there is no specific allegation has been attributed against him and only on the information of the Chaukidar, the name of
Patna High Court Cr.Misc. No.76449 of 2018(3) dt.30-01-2019 2/2 the petitioner transpired and the petitioner has no criminal antecedent.
Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each in connection with K. Nagar P.S.Case No. 569 of 2013, to the satisfaction of learned Sub Divisional Judicial Magistrate, Purena, subject to the conditions as laid down under Section 438
(2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court. sudha/- (Vinod Kumar Sinha, J) U T
