1. Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 304 (B), 201/34 of the Indian Penal Code.

3. It is a case of dowry death.

4. Petitioner is father-in-law of the deceased. Petitioner is separate in mess and business. Thrust of allegation is against the husband of the deceased who is already been acquitted from the Court of learned A D J X , Gaya on 09.01.2023 in Session Trial No. 266/22/142/22, passed by Additional Sessions Judge X, Gaya . Petitioner

5. Learned Counsel for the State opposes the bail petition .

6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the JMFC Gaya in connection with Paraiya P.S. Case No. 178 of 2021 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
