JUSTICE SHIVAJI PANDEY ORAL JUDGMENT Date: 26-08-2016 Learned counsel for Lalit Narayan Mithila University has come forward with a supplementary counter affidavit that the petitioner would be paid salary for the period from 09.09.1985 to 08.07.1989 but subject to the condition that the petitioner will have to submit the statement of claim along with a certificate from the Principal of the College, indicating that the payment of salary for the aforesaid period has not been paid to him. The University is correct that the petitioner cannot be paid the salary twice.

In such circumstances, let the petitioner should produce a

Patna High Court CWJC No.9942 of 2013 dt.26-08-2016 2/2 certificate from the Principal of the College about the status of the payment of the aforesaid period and file the same before the Vice Chancellor, Lalit Narayan Mithila University, Darbhanga through its Registrar and after filing of such certificate, the respondents are directed to make payment of salary, if any, as per his entitlement as well as per fixation of pay within a period of two months from the date of filing of such certificate.

With the aforesaid observations and directions, this application is disposed of.
