The petitioner is apprehending her arrest in a case registered for the offence punishable under sections 406, 420/34 of the Indian Penal Code.

Prosecution case is that the petitioner and her husband took loan of Rs.1 lac from the informant in August, 2010 with a promise to return but the money was not returned. It is submitted by the learned counsel for the petitioner that there is no proof with regard to payment. Statement has been made in paragraph 3 of the application that the petitioner has no criminal antecedent and with similar accusation the husband of the petitioner has been granted anticipatory bail by a co-ordinate Bench of this Court.

Considering the aforesaid facts, let the petitioner,

Patna High Court Cr.Misc. No.27130 of 2016 (2) dt.05-07-2016 abovenamed, in the event of her arrest or surrender before the court below within a period of twelve weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Barh, Patna in Salimpur P.S.Case No. 172/2014, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
