The petitioner seeks bail in a case registered for the offence punishable under Sections 147, 148, 149, 323, 302, 504 of the Indian Penal Code and Section 27 of the Arms Act. Earlier, prayer for bail of the petitioner was rejected vide order dated 02.03.2021 passed in Cr. Misc. No. 36868 of 2020.

In pursuance to the order dated 22.09.2021, status report of trial in connection with Sonbarsa Raj P.S. Case No. 77 of 2020 has been received and kept at Flag-R, in which it is reported that cognizance has been taken against charge-sheeted accused persons and presently the case is pending for appearance of the absent accused person namely Pawan Mandal. It is further reported that case is fixed for appearance and next date of hearing of this case is on 11.10.2021.

Patna High Court CR. MISC. No.54858 of 2021(3) dt.27-10-2021 2/2 Considering the present stage of the trial, I am not inclined to enlarge the petitioner on bail. Accordingly, his payer for bail is rejected in connection with Sonbarsa Raj P.S. Case No. 77 of 2020 pending before the court of the learned Judicial Magistrate, Saharsa.

Accordingly, the application is dismissed. However, petitioner is at liberty to renew his prayer for bail after framing of charge.
