JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 08-03-2016 On hearing both sides, prima facie, it appears to be a land dispute between the two individuals. The State respondents in the counter affidavit have stated that the petitioner encroached over the government Gairmazrua Aam land and steps are afoot for cancellation of Jamabandi vide Jamabandi Cancellation Case No. 1/12-13.
Any such dispute with respect to the land cannot be adjudicated in the writ application. The petitioner shall be at liberty to approach the appropriate forum/authority for resolution of the dispute and also to contest the said Jamabandi cancellation case which is stated to have been
Patna High Court CWJC No.12662 of 2013 (2) dt.08-03-2016 2/2 initiated by the respondents against the petitioner. The writ application is disposed of.
