Petitioners apprehend arrest in a case registered for the offence punishable under Sections147, 148, 341, 353, 379, 411 of the IPC and section 21 of Mines and Minerals(Development and Regulation) Act and section 15 of Environment Protection Act.

As per the prosecution case, the petitioners along with two other accused persons and 10-15 other unknown persons fled away from the place of occurrence along with JCB and tractors and trucks after assaulting the informant and other

Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. The petitioners have no concern with alleged seized tractors or trucks in any manner nor they were present on the place of occurrence during the relevant time. Petitioners have got no criminal antecedent.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad in connection with Barun P.S. Case No. 150 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
