====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 12-12-2017 Heard learned counsels for the petitioners and the State. The petitioners, already in custody, seek bail in connection with Jokihat P.S.Case No. 306 of 2017 registered under Sections 147, 149, 307, 323, 324, 325, 341, 379, 448, 504 and 506 of the Indian penal Code.
Allegation in brief is that while the informant's son was talking on mobile in front of the house of the accused persons, they protested and variously armed with weapons came there and one of the petitioner gave Farsa blow on the head of the informant's son causing injury and other accused persons also assaulted family members of the informant.
Learned counsel for the petitioners submits that allegation
Patna High Court Cr.Misc. No.57796 of 2017 (2) dt.12-12-2017 2/2 against the petitioner no. 1 is of giving single blow on the head and corresponding injury is simple in nature and there is no specific allegation against the petitioner no. 2 and both have clean antecedents.
Having considered the aforesaid facts and circumstances, the petitioners, namely , Abdul Rahim @ Abdur Rahim @ Rahim and Rahbar are directed to be released on bail upon furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Jokihat P.S.Case No. 306 of 2017.
