Petitioner seeks bail in a case registered for the offences punishable under Section 395 of the Indian Penal Code. The FIR of the occurrence of dacoity is against unknown. The petitioner was apprehended in this case on the basis of information supplied by the spy. The petitioner is in custody since 02.05.2017. However, he was not put on T.I. Parade and during investigation nothing incriminating was found against him. Investigation is now complete.

In the circumstances, there is no reason to detain the petitioner in custody as undertrial prisoner. Considering the aforesaid facts, let the petitioner,

Patna High Court Cr.Misc. No.57930 of 2017 (3) dt.05-01-2018 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.Tr.No.85 of 2017 arising out of Gaya Muffasil Police Station Case No.519 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
