Mr.Sri Rajendra Singh Shastriji ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 06-03-2019 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in S.Tr. No. 252/2018, arising out of Naugachia P.S. Case No. 284/2017, instituted for offence under Section(s) 302, 120(B) of the Indian Penal Code read with Section 27 of Arms Act.

It is alleged in the written report that on the date of occurrence at about 12 O'clock husband of informant had gone to Naugachia Court from the house by motorcycle. After court work he was returning at 3:15 P.M. He reached near State Boring at the village Nagrah along with Anganbari Sahayika Nilam Devi then aforesaid Nilam Devi in conspiracy with Kaushal Harijan, Sona Yadav, Tunna Yadav along with petitioner jointly fired on the husband of informant and killed

Patna High Court CR. MISC. No.75683 of 2018(4) dt.06-03-2019 2/2 him. It is further alleged that Nilam Devi had called the husband of informant to go to the Court with her.

Learned counsel for the petitioner has submitted that mere suspicion has been raised against this petitioner. One of the co-accused has already been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 80682/2018 dated 27.02.2019.

Petitioner is in custody since 26.07.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. District & Sessions Judge, Naugachia, Bhagalpur in connection with S. Tr. No. 252/2018, arising out of Naugachia P.S. Case No. 284/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
