2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 126(2), 127(2), 115(2), 109, 303(2), 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, while the informant was on his way to the CSP (Customer Service Point) shop, all the FIR named accused persons including these petitioners intercepted him. Petitioner no.2 abused and assaulted the informant with iron pipe and snatched Rs.3.65 lacs, whereas petitioner no.1 snatched gold chain by pointing pistol on the head. Accused persons also assaulted family members of the informant.

4. Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. Petitioner no.1 is a businessman and

No.47441 of 2025(3) dt.02-09-2025 2/2 when they protested encroachment made by the informant on a public road as well as their entrance of residence, informant and others physically assaulted the petitioners side for which Jamo Bazar Police Station Case No. 138 of 2025 was lodged by wife of petitioner no.2 against the informant and ten other persons. No incriminating article has been recovered from the conscious possession of the petitioners.

5. Learned counsel for the State and the informant oppose the prayer for bail. He submits that petitioners are named in the FIR with specific allegation of snatching cash on the point of pistol from the informant. Petitioner no.1 has criminal antecedent of five cases.

6. Considering the nature of accusation and criminal antecedent, prayer for bail of the petitioners is rejected. (Prabhat Kumar Singh, J) Shashi U T
