Deceased Mala Devi has met with dowry death within four years of her marriage as the prosecution party failed to fulfill the demand of Rs. 1 Lac and a motorcycle and for that, she was regularly tortured.

From the order impugned, it is evident that cause of death of deceased happens to be asphyxia caused by throttling but, considering the status of the petitioner to be cousin father-in-law of the deceased carrying omnibus allegation and is under custody since 22.10.2017, petitioner, Radhanand Patel is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in Khagaria (Mufassil) PS Case No. 386/2017.
