JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 22-06-2017 The present application has been filed for quashing the order dated 20.05.2014 passed by Respondent No. 3, Collector, Vaishali at Hajipur, as contained in Annexure-9, whereby the petitioner being Panchayat Secretary has been dismissed from service which has been affirmed by the Commissioner, Tirhut Division, Muzaffarpur vide the order dated 02.03.2015 passed in Service Appeal No. 19 of 2015, as contained in Annexure -11, hence, quashing of the same has also been prayed for.

A slip has been filed to the effect that both the orders have been challenged in Board of Revenue in Service

Patna High Court CWJC No.16290 of 2015 (2) dt.22-06-2017 2/2 Revision Case No. 43 of 2017 along with the petition for condonation of delay. Hence, the present writ application may be permitted to be withdrawn.

Permission is accorded.

The Member Board of Revenue will be at liberty to condone the delay in filing the revision in view of the fact that the petitioner was pursuing his remedy through the present writ application since 2015 before this Court.

Accordingly, this writ application is disposed of as withdrawn.
