JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-07-2019 This application, for grant of anticipatory bail, arises out of Bettiah Muffasil (Manuapool) P.S. Case No. 175 of 2019, disclosing offences under Sections 419/420 of the Indian Penal Code.

Prosecution case as per the written report of the informant that petitioner is engaged in crushing the rejected cement and selling the same by packing it in new bag, thereafter, the police raided the place and brought the tractor loaded with such cements to the police station. Submission of learned counsel for the petitioner is that the entire allegation is false and concocted, which will appear from the fact that there is no seizure of crushed cement an there is nothing to prove that the petitioner used the crushed

Patna High Court CR. MISC. No.41334 of 2019(2) dt.04-07-2019 2/2 cement and packed the same in new bags. Further submission is that petitioner has earlier lodged a complaint against the informant, who is a Sarpanch and only due to which, he has lodged this present false case.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Bettiah Muffasil (Manuapool) P.S. Case No. 175 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
