2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 406, 420, 467, 468, 469, 471 of the Indian Penal Code.

3. As per the prosecution case, petitioner along with co-accused persons misappropriated the amount of death-cumretiral benefit of the father of informant.

4. It is submitted that as a matter of fact, after the death of the informant's father, the amount of death-cum-retiral benefit of the father of informant was given to the father of deceased namely, Raj Bihari Singh in the year 2013-14 at that point of time, informant was minor. Later on, at the instance of her mother namely, Guriya Devi @ Ranju Devi, this false and fabricated case has been lodged by the informant against the petitioner, other family members including uncle, aunt and Grandmother. Petitioner is not the family member of informant rather he is co-villager and is witness of Sahar PS Case No. 14 of 2011 in which mother of informant is accused. Similarly situated co-accused Tunni Devi has been granted bail. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Bhojpur at Ara in connection with Sahar P.S. Case No. 75 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
