This is an application for regular bail in connection with Givundganj P. S. Case No. 148 of 2017 registered for the offences punishable under Sections 341, 323, 414, 504 and 506/34 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.

Informant in his complaint has alleged that on 15.06.2017 at about 6 P.M. when he was returning to his house accused petitioner and co-accused Sandeep Sah stopped his motorcycle, called him and pressed his neck by chain and while doing so nearby people gathered and caught hold of three persons including petitioner and it is alleged that one country made pistol was recovered from the possession of petitioner and that was produced before the Sarpanch. Patna High Court Cr.Misc. No.409 of 2018(2) dt.17-01-2018 2/2 was called to arrest petitioner and other accused persons. It has been submitted that petitioner is innocent and has falsely been implicated in this case. No recovery is made from his possession. It has further been stated that petitioner has no criminal antecedent and he is in custody since 16.06.2017.

Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Govindganj P. S. Case no. 148 of 2017.
