The petitioner is in custody in connection with Bypass P.S.Case No.199 of 2017 registered for an offence under Sections 363, 366, 370 and 372 of the IPC.
It is alleged that the FIR named accused Malti Devi abducted two daughters of the informant on the pretext of getting them employed at Delhi. In course of investigation one of the victim was recovered. She was produced before Magistrate where she disclosed that she was sold to Narayan Tiwari with whom she has married and is presently she is residing with him. The said Narayan Tiwari has been granted bail by the Special Judge, POCSO Act, Patna on 02.11.2017. The another daughter of the informant Babita Kumari in her statement given before Magistrate
Patna High Court Cr.Misc. No.63024 of 2017 (2) dt.11-01-2018 2/2 has stated that she was sold to one Chandrashekhar who confined her in a room and committed rape on her. She has not stated anything against this petitioner. The learned counsel further submits that the petitioner is in custody since 22.09.2017 having clean antecedent.
Learned APP opposed the submissions.
In the facts and circumstances of the case, prayer for bail is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.25,000/- (twenty five thousand only) with two sureties of the like amount each to the satisfaction of Special Judge, POCSO Act, Patna in connection with Special Case No.145 of 2017 arising out of Bypass P.S.Case No.199 of 2017 with condition that one of the bailors should be the close family members of the petitioner.
