JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-11-2017 Earlier prayer for anticipatory bail of the petitioner was disposed of with direction to the petitioner to surrender within a period of eight weeks before the court below along with a Bank Draft for Rs. 5 lakhs in the name of informant, which was directed to be deposited in the court below which shall not be encashed till the disposal of the case, and if the court is satisfied with the same, she shall be released on bail. Submission of learned counsel for the petitioner , in the meantime, parties have filed a compromise petition and a permission petition before the court below stating that parties have settled their disputes through a Panchayati and the petitioner has paid the entire amount of Rs. 11 lakhs to the informant through

Patna High Court Cr.Misc. No.56804 of 2017 (2) dt.29-11-2017 two different cheques and as such the petitioner could not surrender within the time prescribed in the order dated 11.08.2017 and therefore, may be allowed.

In view of the above facts, this application is disposed of with direction to the petitioner to surrender within a period of three weeks from the date of receipt of this order along with relevant documents showing that compromise has been reached between the parties and petitioner has paid entire amount to the informant and pray for regular bail and if any such application is filed, the court below, considering the submission of learned counsel for the petitioner and being satisfied with same, shall dispose of the application of the petitioner, if possible on same day.
