JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-07-2017 The appellants seek pre arrest bail in connection with Khaira P.S.Case No.113 of 2016 dated 15.5.2016 G.R.No.762 of 2016, registered for offences punishable under Sections 147, 149, 3223, 341, 504, 354 and 506 of the Indian Penal Code and section 3(i)(x) of SC/ST (Prevention of Atrocities) Act. Argument of the learned counsel for the appellant is that no case is made out under SC/ST (Prevention of Atrocities) Act. there is land dispute between the parties and there is a case an counter case also.

Heard learned Special P.P. also, who has stated that the appellant has abused the informant, a lady, by taking caste name. She has also been assaulted, as such this appeal is not maintainable.

In view of above facts and circumstances, let appellant

Patna High Court CR. APP (SJ) No.1172 of 2016 (4) dt.01-07-2017 2/2 surrender before the court of Special Judge and make prayer for regular bail, which will be considered on its own merit without being prejudiced by this order of this Court, if possible on the same day.
