The petitioner apprehends his arrest in Kazi Mohammadpur P.S. Case No. 97 of 2015, corresponding to Sessions Trial No. 450 of 2015 registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.

The FIR was lodged against unknown after recovery of the dead body. During course of investigation the name of the petitioner figured in the case but nobody has seen the petitioner in the company of the deceased. The cousin of the deceased disclosed that the petitioner and two others had taken money from the deceased for providing him job.

Learned counsel for the petitioner submits that save and except suspicion there is no material against the petitioner.

Patna High Court Cr.Misc. No.46100 of 2016 (3) dt.22-06-2017 2/2 Learned APP did not dispute this fact.

Considering the facts aforesaid and the fact that save and except suspicion there is no material against the petitioner, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Muzaffarpur in Kazi Mohammadpur P.S. Case No. 97 of 2015, corresponding to Sessions Trial No. 450 of 2015, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J.)
