Petitioner is an accused in a case registered for offence under sections 302/120B and other allied sections of the Indian Penal Code and under section 27 of the Arms Act on the allegation that the petitioner and other two accused persons fired killing informant's husband and one Dipu. Petitioner is alleged to have shot at the chest and right ear of the informant's husband causing his death at the spot.

Learned counsel for the petitioner submits that the informant is not the eye witness to the occurrence and the petitioner has been implicated in this case due to previous enmity. There is a counter case also. Petitioner is in custody since 8.8.2018.

Learned counsel for the informant opposes the prayer

Patna High Court CR. MISC. No.43855 of 2019(3) dt.25-09-2019 2/2 for bail submitting that petitioner is the assailant of the deceased and he has criminal antecedent.

In view of the nature of allegation against the petitioner, his prayer for bail is rejected.
