The petitioner seeks bail in Bhagwanpur P.S. Case No. 45 of 2021, registered for the offence punishable under Sections 25(1-b)a, 26, 35 of the Arms Act.

As per the prosecution case, on the disclosure made by petitioner one country made pistol has been recovered from the field of Ram Kumar Choudhary.

It is submitted on behalf of the petitioner that no arms and ammunition has been recovered from possession of this petitioner. Petitioner is in custody since 23.02.2021. Counsel for the informant however vehemently opposed the prayer for bail.

Considering the facts and circumstances of the case,

Patna High Court CR. MISC. No.54401 of 2021(2) dt.29-01-2022 2/2 the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Bhagwanpur P.S. Case No. 45 of 2021.
