The petitioners seek bail in a case instituted for the offences under Sections 420 and 406 of the Indian Penal Code. Prosecution allegation, in short, is that the accused persons have not submitted the requisite documents as called for from them relating to appointment of teachers. It has been submitted on behalf of the petitioners that the petitioners are in custody since 20.5.2019 and petitioner no. 1 has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. Petitioner no. 1 is Ex-Mukhiya and petitioner no. 2 is present Mukhiya of
Patna High Court CR. MISC. No.41802 of 2019(2) dt.08-07-2019 2/2 the Panchayat. Certain documents were sought for from the petitioner and the Panchayat Secretary in resepct of the appointment of Panchayat Teacher. Same was not submitted within the time. Hence, the F.I.R. was instituted. It has been submitted that the documents in question have already been submitted. Other co-accuseds have been granted bail vide Annexure-5 series to the present application. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Nawada in connection with Nardiganj P.S. Case No. 17/2016.
