The appellant seeks pre-arrest bail in connection with Hajipur Sadar P.S. Case No. 131 of 2018 for the offence registered under Sections 147, 149, 341, 447, 448, 323, 325, 379, 427, 504 and 506 the Indian Penal Code and Sections 3(i) (r)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
Learned counsel for the appellant submits that there is general and omnibus allegation against the appellant. It is further submitted that no case is made out under the provisions of the SC/ST Act. It is further submitted that no one has injured in the alleged occurrence.
Having heard both sides and in the facts and
Patna High Court CR. APP (SJ) No.144 of 2021(2) dt.27-10-2021 2/2 circumstances of the case, let the appellant, above named, in the event of his arrest/surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 1st Additional Session Judge cum Special Judge, Hajipur, Vaishali in connection with Hajipur Sadar P.S. Case No. 131 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
Accordingly, the appeal is allowed and the impugned order dated 21.10.2019 passed in A.B.P. No. 2588 of 2020 is hereby set aside.
